March 31, 2021 Opinion or Order Filing 105 FINDINGS OF FACT AND CONCLUSIONS OF LAW - For the foregoing reasons: With respect to Count I, Defendant Richard E. Witkemper is liable to Plaintiff United States of America, in the amount of $385,705.54, plus interest and other statutory addit ions, for his unpaid trust fund recovery penalty liabilities associated with Maximum Spindle Utilization Inc., for the periods ending June 30, 2005; December 31, 2005; March 31, 2006; June 30, 2006; and September 30, 2006. With respect to Count II , Plaintiff United States of America has valid and subsist-ing federal tax liens on all property and rights to property belonging to Defendant Richard E. Witkemper for the unpaid trust fund recovery penalty liabilities assessed against him associa ted with Maximum Spindle Utilization, Inc. and Plaintiff United States of America may enforce its federal tax liens attached to the residential prop-erty located at 4532 29th Street, Columbus, Indiana 47203. With respect to Count III, Defendant El len F. Witkemper is liable to Defendant United States of America for the net proceeds of the sale of the property located at 1141 South Walnut Street, Edinburgh, Indiana, in the amount of $202,931.01.
