Filing 27 ORDER - This case arises out of a chain of events that resulted in the temporary removal of a foster child, K.J., from the home of her foster parents, Plaintiffs Marquita Ramsey and Courtney Jones. After allegations of child neglect were unsubstan tiated, K.J. was returned to the home, and she was ultimately adopted by Ms. Ramsey and Mr. Jones. Plaintiffs filed the current lawsuit against four employees of Indiana's Department of Child Services ("DCS") arising out of the remo val, alleging violations of 42 U.S.C. § 1983, the Fourth and Fourteenth Amendments to the United States Constitution, and 42 U.S.C. § 1985. Presently pending before the Court is Defendants' Motion to Dismiss Plaintiffs' Complaint. For the reasons described in this Order, the Court GRANTS that Motion 13 . Signed by Judge Jane Magnus-Stinson on 10/5/2018. (APD) |
