IT IS THEREFORE ORDERED ADJUDGED AND DECREED that this action is remanded to Marion Superior Court 14 for all further proceedings, the Clerk is directed to send notice of this order to Marion Superior Court 14. Moreover, Plaintiff's request for costs and attorney fees is denied.
