Filing 10 CLOSED/FINAL JUDGMENT PURSUANT TO FED. R. CIV. PRO. 58 - For the reasons detailed in the accompanying Order, the Court now enters FINAL JUDGMENT in this action. The action is dismissed without prejudice. Copy to Plaintiff via US Mail. Signed by Judge Tanya Walton Pratt on 9/20/2018.(NAD) |
Filing 9 Entry Directing Entry of Final Judgment - This action is dismissed for failure to state a claim. The Entry of August 9, 2018, dismissed the operative complaint pursuant to 28 U.S.C. 1915A. Dkt. #6 . The plaintiff was given a period of time in which to attempt to cure the deficiencies noted in that Entry. The plaintiff filed an amended complaint which suffers from the same deficiencies as her original complaint. Although the plaintiff alleges that other inmates who are currently in disciplinary segregation are being denied written materials, she lacks standing to raise the claims of other inmates. Because she is no longer in disciplinary segregation, she is not currently suffering any constitutional injury. Therefore, this action is properly dismissed for failure to state a claim upon which relief can be granted. 28 U.S.C. 1915A. Judgment dismissing this action shall now issue. Copy to Plaintiff via US Mail. Signed by Judge Tanya Walton Pratt on 9/20/2018.(NAD) |
Filing 8 AMENDED COMPLAINT against MAGGIE BALLARD, LAURIE JOHNSON, L A VANNATTA, filed by KARLA ESTRADA. (Attachments: #1 Copy of Dkt. 6, #2 Exhibit Policy and Administrative Procedure, #3 Envelope)(NAD) |

Filing 6 Entry - Granting In Forma Pauperis Status, Dismissing Complaint, and Directing Further Proceedings. The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. Accordingly, no initial partial filing fee is due at this time. The plaintiff's claim must be dismissed because the plaintiff is not currently suffering any alleged constitutional deprivation. The plaintiff shall have through September 12, 2018, in which to show cause why Judgment consistent with this Entry should not issue. Copy to Plaintiff via US Mail. Motions terminated: #2 IFP filed by KARLA ESTRADA. Signed by Judge Tanya Walton Pratt on 8/9/2018.(NAD) |
