Mr. Johnson requests that the bank accounts of the defendant be frozen and that liens be placed on all vehicles, houses and property of the defendant because he fears that the defendant will try to liquidate his assets while the action is pending. Mr. Johnson's request is premature because no judgment has issued in this case. Moreover, Mr. Johnson has provided no showing or reason to believe that the defendant is trying to liquidate his assets to avoid any future financial liability in this action. August 15, 2018 Opinion or Order Filing 5 Order Screening Complaint and Directing Service of Process - Plaintiff Christopher Michael Johnson is a pretrial detainee currently incarcerated at the Marion County Jail, Indianapolis, Indiana. Because Mr. Johnson is a "prisoner" as defined by 28 U.S.C. 1915(h), this Court has an obligation under 28 U.S.C. 1915A(b) to screen his complaint before service on the defendants. Mr. Johnson's Fourteenth Amendment claim for the denial of constitutionally adequate conditions of confinement against Sheriff Layton shall proceed. Mr. Johnson's First Amendment freedom of religion claim against Sheriff Layton shall proceed. The clerk is designated pursuant to Fed. R. Civ. P. 4(c)(3) to issue process to defendant Sheriff John R. Layton in the manner specified by Fed. R. Civ. P. 4(d). Process shall consist of the complaint (docket #1 ), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. (See Entry).
