| Filing 9 ENTRY - DENYING #7 MOTION FOR TIME, DISMISSING ACTION, AND DIRECTING ENTRY OF FINAL JUDGMENT. The plaintiff seeks a 90 day extension of time to pay the filing fee. He believes he may receive money from a pending small claims court action. The plaintiff's motion for extension of time, dkt. #7 , is denied because payment should have been made at the time the action was filed, and relying on the results of another case for future funds is too speculative. Allowing, in essence, a four month extension of time to pay the filing fee is unwarranted in light of the plaintiff's status of having struck out. The action is therefore dismissed without prejudice for failure to pay the filing fee. Judgment consistent with this Entry shall now issue.
