Filing 9 ORDER - Plaintiff has filed an Amended Complaint, pursuant to the Court's Order dated October 17, 2018, alleging that the Court has diversity jurisdiction over this matter. For the reasons stated in this Order, the Court ORDERS Plaintiff to file a Second Amended Complaint on or before November 9, 2018, which properly alleges a basis for the Court's diversity jurisdiction. Filing 7 ORDER - Plaintiff, an LLC, has filed a Complaint in which it alleges that this Court has diversity jurisdiction over this matter. Because "the citizenship of unincorporated associations must be traced through however many layers of partners or members there may be," Plaintiff must allege both the "identity and citizenship" of each of its members. Plaintiff's Complaint fails to allege either the identity or citizenship of its members, and thus fails to establish the complete diversity of the parties. Therefore, the Court ORDERS Plaintiff to file an Amended Complaint on or before October 26, 2018 which properly alleges a basis for this Court's diversity jurisdiction. (See Order). Signed by Judge Jane Magnus-Stinson on 10/17/2018.(APD) |
