Filing 7 Entry Dismissing Complaint and Directing Filing of Amended Complaint - The plaintiff is a prisoner currently incarcerated at Miami Correctional Facility ("Miami"). Because the plaintiff is a "prisoner" as defined by 28 U.S.C. 1915 (h), this Court has an obligation under 28 U.S.C. 1915A(b) to screen his complaint before service on the defendants. First, all claims against Warden D. Fender are dismissed because the complaint contains no factual allegations against D. Fender. Second, all claims against Marion County Jail 1 are dismissed because the jail is not a "person" subject to suit pursuant to 42 U.S.C. 1983. Third, all claims against Wexford are dismissed. Because the Court has been unable to identify a viable claim for relief against any particular defendant, the complaint is subject to dismissal. The dismissal of the complaint will not in this instance lead to the dismissal of the action at present. Instead, the plaintiff shall have through December 17, 2018, in which to file an amended complaint. The clerk is directed to include a copy of the civil rights complaint form with the plaintiff's copy of this Entry. (SEE ENTRY).
