December 20, 2018 Opinion or Order Filing 11 ENTRY Screening Complaint, Dismissing Insufficient Claim, and Directing Service of Process - The claim against Corizon must be dismissed for failure to state a claim upon which relief can be granted at this time. This claim against Wexford shall proceed. This discussion of the claims includes all the viable claims identified by the Court in the complaint. If Mr. Middleton believes that additional claims were alleged in the complaint, but were dismissed or not identified by the Court, he shall have through January 31, 2019, in which to identify those claims. The pro se plaintiff shall report any change of address within seven (7) days of any change. If the plaintiff fails to keep the Court informed of his current address, the action may be subject to dismissal for failure to comply with Court orders and failure to prosecute. The clerk is directed pursuant to Fed. R. Civ. P. 4(c)(3) to issue process to defendant Wexford in the manner specified by Rule 4(d). Process shall consist of the complaint filed on November 13, 2018 (docket 1), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. The clerk shall terminate Corizon as a defendant. The clerk shall send a courtesy copy of this Entry to attorney Douglass Bitner. (See Entry.)
