Filing 5 Order Screening Complaint and Directing Further Proceedings - Process will issue to Wexford and the Warden of the Pendleton Correctional Facility, in his official capacity only, for the purpose of permitting them to appear in the action and respond to discovery regarding the identity of personnel who could be properly named as defendants in this action. The clerk is designated, pursuant to Fed. R. Civ. P. 4(c)(3), to issue and serve process on Wexford and the Warden in the manner specified by Fed. R. Civ. P. 4(d)(1). Process in this case shall consist of the complaint, applicable forms and this Entry. Wexford and the Warden need not answer the allegations of the complaint at this time, but simply need to appear in the action. Once Wexford and the Warden appear in the action, the plaintiff shall have 45 calendar days in which to serve discovery on them. Any such discovery shall be limited in scope to ascertaining the identity of any person who could actually be liable to the plaintiff for the violation of his federally secured rights he alleges. ***SEE ORDER FOR ADDITIONAL INFORMATION*** (Copy to Plaintiff via U.S. Mail) Signed by Judge James R. Filing 4 Order on In Forma Pauperis Status - The plaintiff's motion to proceed in forma pauperis, dkt. #2 , is granted. The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. 28 U.S.C. 1915(b)(4). Accordingly, no initial partial filing fee is due at this time. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2) when able.
