Filing 11 ENTRY Directing Further Proceedings - On March 15, 2019, the Court ordered the plaintiff to pay an initial partial filing fee of Eighty-Six Dollars and Forty-Five Cents ($86.45) by April 15, 2019. That deadline has passed, and the plaintiff has failed to do so. Instead, he filed a motion to amend and supplement his complaint. This action will not proceed unless and until the initial partial filing fee has been paid. Therefore, the plaintiff shall have through May 20, 2019, to pay the initial partial filing fee or explain why doing so is not possible. The failure to do so by this date will result in the dismissal of this action without further warning. See 28 U.S.C. 1915(b)(1) (requiring court to assess and collect an initial partial filing fee). Signed by Judge James Patrick Hanlon on 4/22/2019. Copy to Plaintiff via US Mail. (DWH) |

The plaintiff's motion for pretrial conference, dkt. #5 , is denied as premature. Signed by Judge James Patrick Hanlon on 3/18/2019. Copy to Plaintiff via US Mail. (DWH) |
Filing 8 ORDER ON MOTION TO PROCEED IN FORMA PAUPERIS - The plaintiff's motion to proceed in forma pauperis, dkt. #2 , is granted to the extent that the plaintiff is assessed an initial partial filing fee of Eighty-Six Dollars and Forty-Five Cents ($86.45). See 28 U.S.C. 1915(b)(1). The plaintiff shall have through April 15, 2019, in which to pay this sum to the clerk of the district court. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2) when able. See 28 U.S.C. 1915(b)(1) ("[T]he prisoner shall be required to pay the full amount of a filing fee."). Signed by Judge James Patrick Hanlon on 3/15/2019. Copy to Plaintiff via US Mail. (DWH) |
