ORDER STRIKING NOTICE OF INITIAL ENLARGEMENT OF TIME: On March 27, 2019, Defendants Anthem Insurance Companies, Inc. and Anthem, Inc. (collectively "Anthem Defendants") filed a Notice of Initial Extension of Time to Respond to Plaintiff's Complaint [Dkt. 8], purporting to obtain an automatic initial 28- day enlargement of time to respond to Plaintiff's Complaint, from April 1, 2019 to and including April 29, 2019 pursuant to Local Rule 6-1(b). However, Local Rule 6-1(b) may only be invoked if the deadline for a filing a response to a pleading has not been previously extended. S.D. Ind. L.R. 6-1(b)(1). On March 13, 2019, Anthem Defendants filed a Notice of Automatic Enlargement of Time to Respond to Plaintiff's Complaint, by which they obtained an initial enlargement of time from March 20, 2019 to and including April 19, 2019 to respond to Plaintiff's Complaint. [Dkt. 1-2 at 35]. Consequently, Anthem Defendants were precluded from filing a "notice" pursuant to Local Rule 6-1(b). Accordingly, the Court hereby STRIKES Anthem Defendants' Notice of Initial Extension of Time to Respond to Plaintiff's Complaint. [Dkt. 8.] The Clerk is directed to show Docket No. 8 as stricken from the docket. Anthem Defendants' response to Plaintiff's Complaint is due on or before April 19, 2019, as previously enlarged prior to the removal of this action. Signed by Magistrate Judge Mark J.
