June 20, 2019 Opinion or Order Filing 60 Order on Pending Motions - Plaintiff Charles Barker's motion for leave to amend the complaint, dkt. #47 , is granted. The clerk is directed to file the tendered amended complaint, dkt. 47-1, as the plaintiff's first amended complaint. It will be the operative complaint. The Court has screened the amended complaint pursuant to 28 U.S.C. 1915A. The claims presented shall proceed as consistent with the original screening order of April 3, 2019. Dkt. #9 . Mr. Barker's motion for power of attorney to appear for him, dkt. #48 , is denied. Only licensed attorneys, or a pro se party, may appear for a party. Additionally, the Court has recruited counsel to assist Mr. Barker, and that counsel will appear for Mr. Barker. The motion for a preliminary injunction, dkt. #4 , is denied without prejudice. Mr. Barker seeks specific medical care and contends he is almost certain to prevail. However, the defendants have raised the issue of a lack of exhaustion of administrative remedies. Proceedings in this case not related to the issue of exhaustion have been stayed. Mr. Barker can only prevail in this action if he has exhausted his administrative remedies or the defendants waive the defense. Mr. Barker is now represented by recruited counsel. The Court will communicate with the parties through counsel, and Mr. Barker should discontinue pro se filings while represented. ( See Order.) Copy to Plaintiff via US Mail.
