The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. For the reasons discussed herein and in the other two screening Entries, dkt. #5 and dkt. #8 , this action is dismissed as frivolous. Judgment consistent with this Entry shall now issue. May 15, 2019 Opinion or Order Filing 8 ENTRY - GRANTING MOTION TO AMEND, SCREENING AND DISMISSING AMENDED COMPLAINT, AND AGAIN DIRECTING PLAINTIFF TO SHOW CAUSE. Mr. Boyd may amend his complaint as a matter of right at this point in the litigation. Rule 15(a) of the Federal Rules of Civil Procedure. Therefore, his motion to amend, dkt. #7 , is granted. Boyd continues to have through May 31, 2019, in which to either pay the $400.00 filing fee for this action or demonstrate that he lacks the financial ability to do so. For the same reasons set forth in the Entry of May 8, 2019, dkt. #5 , the amended complaint is dismissed for failure to state a claim upon which relief can be granted. Boyd's amended complaint must be dismissed for the reasons discussed in this Entry and the Entry of May 8, 2019. Boyd shall have through May 31, 2019, in which to show cause why Judgment consistent with this Entry should not issue. If Boyd fails to respond to this order to show cause, the case will be dismissed in accordance with 28 U.S.C. 1915A(b) for failure to state a claim upon which relief can be granted without further notice.
