Filing 18 ENTRY DENYING MOTION TO ALTER OR AMEND JUDGMENT - Mr. Hughes does not argue that the Court committed a manifest error or that newly discovered evidence precludes the Court's ruling. Rather, he asks the court to show "mercy" and then sets out new allegations describing events that have taken place since he filed his complaint. Unfortunately, neither is a basis for relief under Rule 59 (e). Mr. Hughes' motion, dkt. #13 , is therefore denied. (Copy to Plaintiff via U.S. Mail) Signed by Judge James R. Sweeney II on 6/11/2019. Filing 5 ENTRY DENYING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS, DISMISSING ACTION, DIRECTING ISSUANCE OF ENTRY TO WARDEN, AND DIRECTING ENTRY OF FINAL JUDGMENT - Thus, Mr. Hughes' motion for leave to proceed in forma pauperis, dkt. #2 , is denied, and this action is dismissed with prejudice. If the harm alleged in the complaint is ongoing, nothing in this Entry prohibits Mr. Hughes from filing a new civil action asserting claims based on circumstances that apply after the entry of final judgment in this case. If Mr. Hughes does so, he must also pay the $400.00 filing fee or file a motion for leave to proceed in forma pauperis that (1) discloses that he has incurred three strikes, and (2) explains why the complaint is subject to the "imminent danger of serious physical injury" exception to 1915(g). Because Mr. Hughes' complaint alleges that he is not receiving medication for a serious medical condition, the clerk is directed to issue a copy of this Entry and Mr. Hughes' complaint, dkt. #1 , to theWarden of New Castle Correctional Facility so he may bring this issue to the attention of the prison's medical staff. Final judgment consistent with this Entry shall now issue. (Copy to Plaintiff via U.S. Mail) Signed by Judge James R. Sweeney II on 5/14/2019. (JDC) |
