Filing 4 CLOSED TRANSFER to Northern District of Indiana at South Bend - Order Transferring Action to Northern District of Indiana - Plaintiff Markeese Hunter is incarcerated at the Miami Correctional Facility in Bunker Hill, Indiana. He brings this civil rights action alleging that prison staff at Miami Correctional Facility violated his constitutional rights. Bunker Hill, Indiana lies in Miami County. Miami County is in the Northern District of Indiana. 28 U.S.C. 94(a)(2). Here, the alleged misconduct giving rise to the claims occurred in the Northern District of Indiana and the defendants can be located there. Although Commissioner Carter, a state-wide official, is named as a defendant in the caption of the complaint, there are no allegations of wrongdoing asserted against him, so that defendant does not militate against the transfer. Under these circumstances, the appropriate venue for the action is the Northern District of Indiana. See 28 U.S.C. 1391(b); 28 U.S.C. 1404. The motion to proceed in forma pauperis has not been resolved.
