Filing 6 CLOSED DISMISSED - FINAL JUDGMENT PURSUANT TO FED. R. CIV. P. 58 - For the reasons set forth in the Court's Order entered this day, the Court now enters FINAL JUDGMENT and DISMISSES Plaintiff's Complaint WITHOUT PREJUDICE for lack of subject-matter jurisdiction. Copy to Teresa Simmons via U.S. mail. Signed by Judge Jane Magnus-Stinson on 8/29/2019.(JDH) |
Filing 5 ORDER - Plaintiff filed this matter on July 2, 2019, [Filing No. 1], along with a Motion for Leave to Proceed In Forma Pauperis, [Filing No. 2]. On July 12, 2019, the Court dismissed Plaintiff's Complaint without prejudice for failing to allege a viable claim. [Filing No. 4 at 4-5.] The Court directed Plaintiff to file an amended complaint on or before August 12, 2019 to address the noted deficiencies. [Filing No. 4 at 4.] Plaintiff neither filed an amended complaint by the August 12, 2019 deadline nor sought an extension of that deadline. Therefore, final judgment will now issue dismissing this matter for lack of jurisdiction. Copy to Teresa Simmons via U.S. mail. Signed by Judge Jane Magnus-Stinson on 8/29/2019.(JDH) |
Filing 4 ORDER - Pro se Plaintiff Teresa Simmons has filed a Complaint without prepaying the filing fee. This Order addresses Ms. Simmons' Motion to Proceed In Forma Pauperis, [Filing No. 2], screens her Complaint, [Filing No. 1], and directs further proceedings. The Court GRANTS Ms. Simmons' Motion to Proceed In Forma Pauperis. #2 The Court DISMISSES Ms. Simmons' Complaint WITHOUT PREJUDICE for failure to state a claim. Ms. Simmons may file an Amended Complaint on or before August 12, 2019. Any Amended Complaint should contain only "a short and plain statement of the grounds for the court's jurisdiction;... a short and plain statement of the claim showing that the pleader is entitled to relief; and a demand for the relief sought...." Fed. R. Civ. P. 8(a). Further, any Amended Complaint may only contain allegations which arise out of the same transaction, occurrence, or series of transactions or occurrences and may not allege any claims challenging any state-court judgments or convictions. Because Ms. Simmons has not alleged a viable claim, no summons shall issue at this time. (See Order). Copy to Teresa Simmons via U.S. mail. Signed by Judge Jane Magnus-Stinson on 7/12/2019. (JDH) |
