Filing 5 FINAL JUDGMENT -The Court having this day made its Entry directing the entry of final judgment, the Court now enters FINAL JUDGMENT. The action is dismissed for lack of jurisdiction. Signed by Judge Sarah Evans Barker on 8/15/2019. Copy Mailed.(CKM) |
Filing 4 ORDER - Dismissing Motion to Vacate, Set Aside, or Correct Sentence and Denying a Certificate of Appealability; Mr. Taylor may be able to obtain permission from the Seventh Circuit to file another successive 2255 motion, but until he does so, he cannot file one. This action is therefore dismissed for lack of jurisdiction. Judgment consistent with this Entry shall now issue and a copy of this Entry shall be docketed in No. 1:08-cr-00039-SEB-KPF-1. The motion to vacate (Crim. Dkt. 95) shall also be terminated in the underlying criminal action. Pursuant to Federal Rule of Appellate Procedure 22(b), Rule 11(a) of the Rules Governing 2255 proceedings, and 28 U.S.C. 2253(c), the Court finds that Mr. Taylor has failed to show that reasonable jurists would find it "debatable whether [this Court] was correct in its procedural ruling." Slack v. McDaniel, 529 U.S. 473, 484 (2000). The Court therefore denies a certificate of appealability. Signed by Judge Sarah Evans Barker on 8/15/2019. Copy Mailed.(CKM) |
