Filing 9 ORDER: This matter comes before the Court on Defendants' Motion for Initial Enlargement of Time to Respond to Plaintiff's Complaint. [Dkt. 7.] Defendants' motion is subject to summary denial because it was not filed at least three business days prior to Defendants' October 3, 2019 response deadline as required by Local Rule 6-1 (a) (5). However, Local Rule 6-1(b) provides for an automatic enlargement of time to respond to a pleading or any written request for discovery or admissions, with the consent of opposing counsel and not to exceed twenty-eight days, by the simple filing of a notice of such enlargement with the Court. S.D. Ind. L.R. 6-1(b). All of those requirements are met in this instance; therefore, no motion is required. Accordingly, Defendants' motion [Dkt. #7 ] is DENIED AS MOOT; rather, the Court will treat Docket No. 7 as Defendants' notice of automatic enlargement of time to respond to Plaintiff's Complaint to and including October 31, 2019.
