Filing 7 NOTICE of Lawsuit & Waiver Issued by Clerk. (CKM) |
Filing 6 ORDER - SCREENING COMPLAINT AND DIRECTING FURTHER PROCEEDINGS; This summary of remaining claims includes all the viable claims identified by the Court. All other claims have been dismissed. If the plaintiff believes that additional claims were alleged in the complaint, but not identified by the Court, he shall have through November 12, 2019, in which to identify those claims. The plaintiff has not alleged that defendant Holcomb took any action in retaliation against him. Therefore, his retaliation claim against defendant Holcomb is dismissed for failure to state a claim. Because all claims against defendant Holcomb have been dismissed, the clerk is directed to terminate Mr. Holcomb as a defendant on the docket. The clerk is directed pursuant to Fed. R. Civ. P. 4(c)(3) to issue process to defendants Brown and Arnold in the manner specified by Fed. R. Civ. P. 4(d). Process shall consist of the complaint (docket 1), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. Because the defendants are employees of the Indiana Department of Correction, the clerk is directed to serve them electronically. Signed by Judge Sarah Evans Barker on 10/23/2019. Copy Mailed.(CKM) |
