November 4, 2019 Opinion or Order Filing 7 ENTRY DISCUSSING ACTION AND DIRECTING SERVICE - Ms. Reaves' Motion to Proceed In Forma Pauperis, #6 , is GRANTED. At this time, the Court has not determined that the action must be dismissed pursuant to28 U.S.C. 1915(e), and therefore the action shall proceed as to the following claims: a.retaliation under the FMLA; b.discrimination and retaliation under the ADA; and c.discrimination and hostile work environment under Title VII. Ms. Reaves' claim for breach of contract under state law is DISMISSED WITHOUT PREJUDICE. Because Ms. Reaves is proceeding in forma pauperis, Federal Rule of Civil Procedure 4(c)(3) requires the Court to order service. Accordingly, the clerk is designated pursuant to Rule 4(c)(3) to issue process to Defendant Maximus Incorporation in the manner specified by Rule 4(d). Process shall consist of the Complaint, [Filing No. 1], applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. If Ms. Reaves believes that additional claims were alleged in the Complaint, but not identified by the Court in this Entry, she shall have until December 4, 2019 to identify those claims.
