ORDER granting #2 Motion for Leave to Proceed in forma pauperis. That motion is granted to the extent that Plaintiff is assessed an initial partial filing fee of Seventeen Dollars and Ninety-Four Cents ($17.94). See 28 U.S.C. 915(b) (1). Plaintiff shall have through December 13, 2019, in which to pay this sum to the clerk of the district court. Although Plaintiff is excused from pre- paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2) when able. See 28 U.S.C. 1915(b)(1) ("[T]he prisoner shall be required to pay the full amount of a filing fee."). The Court must screen the Complaint. While Plaintiff may have a claim against Defendants, it is unclear from the Complaint, which is lacking in any factual assertions of how Plaintiff claims his rights were violated. It may be that Defendants are immune from suit or Plaintiff's claims are otherwise barred. It also may be that Plaintiff is seeking review of his state court conviction. Without any factual allegations, the asserted claim(s) cannot be determined. Therefore, Plaintiff is ordered to file no later than December 13, 2019, an Amended Complaint asserting facts to state a claim against Defendants.
