For the reasons set forth in Part II(C)(1), Mr. Noel's complaint is dismissed pursuant to Federal Rule of Civil Procedure 12(h)(3) for lack of subject matter jurisdiction. He shall have through January 13, 2020, to either show cause why Judgment consistent with this Entry should not issue or file an amended complaint which cures the deficiencies discussed in this Entry. Mr. Noel shall also have through January 13, 2020, to pay his initial partial filing fee as directed in Part I. The clerk is directed to update the docket to reflect that the defendants named in the complaint are John Green, Franklin Wooten, and Kenneth Greer; Marion County Clerk of Court Myla Eldridge; Marion County Prosecutors Terry Curry, Michelle Sharp, and Denis Robinson; and "City of Indpls., I.M.P.D., State of IN."
