April 29, 2020 Filing 10 ENTRY GRANTING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS, SCREENING AMENDED COMPLAINT, AND DIRECTING ISSUANCE OF PROCESS - Mr. Taylor's motion for leave to proceed in forma pauperis, dkt. #8 , is granted to the extent discussed in Part I. The action shall proceed with First Amendment retaliation claims against Agent Duncan and Supervisor Steve pursuant to 42 U.S.C. 1983. These claims shall proceed against the defendants in their personal capacities only. All other claims are dismissed for failure to state a claim upon which relief may begranted. If Mr. Taylor believes the amended complaint asserts claims that the Court did not address in Part II(C), he shall have through May 29, 2020, to notify the Court. The clerk is directed pursuant to Federal Rule of Civil Procedure 4(c)(3) to issue process to the following defendants in the manner specified by Rule 4(d): (1) District 3 Parole Supervisor Steve, and (2) Parole Agent Adam Duncan. Process shall consist of the amended complaint (dkt. #6 ), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. March 23, 2020 Opinion or Order Filing 4 ORDER DIRECTING PLAINTIFF TO RESOLVE FILING FEE, DISMISSING COMPLAINT, AND DIRECTING FURTHER PROCEEDINGS - For the reasons set forth in Part II(C) above, Mr. Taylors complaint is dismissed for failure to state a claim upon which relief may be granted. He shall have through April 21, 2020, to file an amended complaint that resolves the deficiencies discussed in this Order or otherwise show cause why this action should not be dismissed. The amended complaint must include the case number associated with this action, no. 1:20-cv-00854-JMS-MPB. Any amended complaint will completely replace the original complaint, and it will be screened pursuant to 1915A(b), so it must include all defendants, claims, and factual allegations Mr. Taylor wishes to pursue in this action. Mr. Taylor shall also have through April 21, 2020, to pay the filing fee or move for leave to proceed in forma pauperis as directed in Part I. If Mr. Taylor fails to comply with either order in the time provided, this action may be dismissed without further warning or opportunity to show cause. The clerk is directed to include a form motion for leave to proceed in forma pauperis with Mr. Taylors copy of this Order. (See Order). Copies to Robert Taylor via U.S. mail.
