ORDER DENYING PLAINTIFFS MOTION TO PROCEED IN FORMA PAUPERIS - On March 24, 2020, this Court issued a Notice of Deficiency concerning Mr. Bastons request in his Complaint, dkt. #1 , to proceed in forma pauperis. The Courts Notice instructed Mr. Baston to attach a copy of the transactions associated with his institution trust account for the six-month period preceding the filing of this action on March 19, 2020. See dkt. #4 . On April 16, 2020, Mr. Baston instead filed another motion to proceed in forma pauperis without attaching any trust account information. Mr. Bastons motion to proceed in forma pauperis, dkt. #5 , is denied as presented without prejudice. The Court further notes that Mr. Baston has misrepresented the status of his trust account in at least two prior cases in this district. See Baston v. Indiana Department of Correction, 1:19-cv-04641-JRS-TAB (revoking in forma pauperis status due to misrepresentations and referencing similar misrepresentations in Baston v. State of Indiana, 4:19-cv-15-RLY-DML). Mr. Baston has also been warned that if he continues to make false representations about his trust account, he may be sanctioned and restricted from filing any additional papers in this district. See id. at dkt. 12. Therefore, Mr. Baston shall have until June 5, 2020, to either pay the full filing fee or renew his motion to proceed in forma pauperis by attaching a copy of the transactions associated with his institution trust account for the six-month period preceding the filing of this action on March 19, 2020.
