April 8, 2020 Opinion or Order Filing 8 ORDER - TRANSFERRING ACTION TO THE NORTHERN DISTRICT OF INDIANA; Petitioner James Shead, Jr. filed a petition for habeas corpus pursuant to 28 U.S.C. 2254 in the Northern District of Indiana. The court transferred the case to this Court, stating that Mr. Shead filed a complaint based on events which occurred at the Floyd County Jail, dkt. #5 , which is located in this district. However, a review of the petition shows that Mr. Shead is confined in Westville Correctional Facility, located in LaPorte County, Indiana, and is challenging a state conviction out of St. Joseph County, Indiana. See dkt. #2 . Because both LaPorte County and St. Joseph County sit in the Northern District of Indiana, see 28 U.S.C. 94(a) (1)(2), that District is the only proper venue for the action based on the allegations in his petition. 28 U.S.C. 2241(d).Therefore, this action is TRANSFERRED back to the United States District Court for the Northern District of Indiana at South Bend, Indiana.
