Filing 5 ORDER - The Court must assess an initial partial filing fee of twenty percent of the average monthly deposits in the prisoners account, or twenty percent of the average monthly balance in the prisoners account for the previous six months, whichever is greater. Id. 1915(b)(1). Here, Mr. Colyer failed to submit an account statement for the six months preceding May 21, 2020, the date the complaint was filed. The Court must have accurate figures to accurately calculate the partial initial filing fee as directed by the statute. Accordingly, Mr. Colyer is allowed forty days from the date of this order to complete and sign the attached affidavit form and to submit a certified prison account statement for the six-month period preceding May 21, 2020, roughly speaking from mid-November 2019 through mid-May 2020. We will reserve our ruling on Mr. Colyers motion to proceed in forma pauperis until he submits these materials, or the 40-day deadline passes, whichever comes first.
