Filing 15 ORDER - The plaintiff's complaint was screened on June 26, 2020, and the plaintiff was instructed to file an amended complaint that includes only those claims that arose during his time at New Castle Correctional Facility between June 9, 2018, and December 20, 2019. See dkt. 6. The plaintiff has through July 27, 2020, to file his amended complaint. Accordingly, the motion for hearing, dkt #11 , and motion for preliminary injunction, dkt #12 , are denied. The June 26, 2020, Entry explained that any claim for injunctive relief must be brought in the plaintiff's district of confinement. Filing 14 Order on In Forma Pauperis Status - The plaintiff's motion to proceed in forma pauperis, dkt. #3 , is granted. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2) when able. See 28 U.S.C. 1915(b)(1) ("the prisoner shall be required to pay the full amount of a filing fee."). The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. 28 U.S.C. 1915(b)(4). Filing 10 ORDER - The plaintiff's complaint was screened on June 26, 2020, and the plaintiff was instructed to file an amended complaint that includes only those claims that arose during his time at New Castle Correctional Facility between June 9, 2018, and December 20, 2019. See dkt. 6. Before he had the opportunity to review the Court's June 26, 2020, Entry, the plaintiff filed a motion for leave to file an amended complaint. The motion for leave to file an amended complaint, dkt #7 , is denied to the extent that the Court will not accept the attached proposed amended complaint. Instead, Mr. Rowe should file an amended complaint consistent the Court's June 26, 2020, instructions. It is for a similar reason that the plaintiff's "Verified Motion for an Evidentiary Hearing on Plaintiff's Motion for TRO and Preliminary Injunction" submitted by the plaintiff for electronic filing on June 24, 2020, dkt #10 , but docketed in this case on July 1, 2020, is denied. Filing 6 ENTRY DIRECTING FILING OF AMENDED COMPLAINT - Jeffrey Allen Rowe is currently incarcerated at the Indiana State Prison in the Northern District of Indiana. He is a frequent litigator in this court and this is his second lawsuit about the treatment he received at New Castle Correctional Facility for the "pea-sized lump in/on his left testicle and/or in/on the tubing that comes off of his left testicle, which started hurting in April 2017." Dkt. 2 at p 2. His first lawsuit has survived summary judgment on certain claims and is proceeding towards trial. Rowe v. Coomer, et al., 1:17-cv-3288-JPH-DLP.
