Filing 10 ORDER - DENYING Plaintiff's #7 MOTION FOR TEMPORARY RESTRAINING ORDER AND Plaintiff's #8 MOTION FOR EMERGENCY TRANSFER. Should the Bates wish to pursue a claim that defendant Dr. Handley has retaliated against him by moving him to disciplinary housing, he may either file a new civil rights complaint or move to amend his complaint in this action to add a retaliation claim. Bates is reminded that he must first exhaust available administrative remedies before filing suit on such a claim. For these reasons, the plaintiff's motion for a temporary restraining order, dkt. #7 , is denied. Finally, the Court is reluctant to interfere with prison administration in the manner the plaintiff requests. For these reasons, the plaintiff's motion for emergency transfer, dkt. #8 , is denied.
