Order Dismissing Action and Directing Final Judgment - Plaintiff filed this action on September 8, 2020. (ECF No. 1.) On September 24, 2020, the Court screened Plaintiff's Complaint pursuant to 28 U.S.C. 1915(e)(2) and determined that it must be dismissed because it fails to state a claim on which relief may be granted and because this Court either lacks or must abstain from exercising jurisdiction with respect to state court proceedings. (ECF No. 9.) The Court directed Plaintiff to file an amended complaint within 30 days of its screening entry to address the noted deficiencies, or to otherwise show cause why judgment consistent with the screening entry should not issue. Plaintiff has neither filed an amended complaint nor has he shown cause why judgment should not issue. The Court notes that Plaintiff is a frequent litigant in this and other courts, and to date, only one of his cases has survived screening. Furthermore, due to his confrontational behavior in the Courthouse and toward a United States District Judge, Plaintiff is the subject of an order of this Court prohibiting his entry to the Courthouse. See In re Mapes, No. 1:20-mc-00008-JMS-DLP (Oct. 15, 2020). This action is dismissed with prejudice for failure to state a claim on which relief can be granted. Plaintiff Eric J. Mapes is reminded that the Court has the authority to restrict his ability to file actions and to assess fines against him for filing frivolous cases. The Court may elect to use this power if Plaintiff does not cease filing frivolous lawsuits. Final judgment consistent with this Order will now issue.
