ORDER - DENYING #10 REQUEST FOR RESTRAINING ORDER AS PREMATURE. Preliminary relief is not yet available to Mr. Maul because "[a]n injunction, like any 'enforcement action,' may be entered only against a litigant, that is, a party that has been served and is under the jurisdiction of the district court." At present, there is no viable Complaint pending before the Court. Mr. Maul must file an Amended Complaint by no later than November 6, 2020. Dkt. #9 . The Court must screen Mr. Maul's Amended Complaint before the defendants will be served in this action. Once these actions have occurred, and if the defendants are served, Mr. Maul may renew his motion for a restraining order at that time. ORDER - GRANTING IN FORMA PAUPERIS STATUS AND DIRECTING FILING OF AMENDED COMPLAINT. For the reasons stated above, Plaintiff's Motion for Leave to Proceed in District Court Without Prepaying the Filing Fee, (Dkt. #8 ), is GRANTED. The Complaint is subject to dismissal for the reasons stated above, and Mr. Maul is granted leave to file an amended complaint. If Mr. Maul files an amended complaint by November 6, 2020, it will be screened. If no amended complaint is filed, this action will be dismissed without further notice or opportunity to show cause. The Clerk is directed to include a copy of the prisoner civil rights complaint form along with Mr. Maul's copy of this Entry. (See Entry.) Copy to Plaintiff via US Mail.
