ORDER - DISMISSING ACTION AND DIRECTING JUDGMENT; Plaintiff Eric J. Mapes, pro se, initiated this action on September 17, 2020, without paying the filing fee or filing a motion for leave to proceed without the prepayment of the filing fee (in forma pauperis).We thus directed Plaintiff to either pay the filing fee for this action or demonstrate his financially unable to do so by filing a motion for leave to proceed in forma pauperis. We ordered him to do so no later than October 15, 2020. This date has now come and gone without a response to the Court's order.The Court understands Plaintiff's motion to state that he did not intend to file a new civil action by his original submission. Accordingly, this action is DISMISSED WITHOUT PREJUDICE. To the extent Plaintiff's demand to cease and desist is cognizable by us given that he also claims he did not intend to initiate a civil action, it is DENIED. Plaintiff ERIC J. MAPES is reminded that the Court has the authority to restrict his ability to file actions and to assess fines against him for filing frivolous cases.
