Filing 5 ORDER - SCREENING COMPLAINT AND DIRECTING SERVICE;Plaintiff Qurtis Mandale Williams, appearing pro se, filed this lawsuit and moved for leave to proceed in forma pauperis. That motion has been previously granted. Plaintiff's claims alleging violations of his Fifth and Fourteenth Amendment rights must be dismissed without prejudice. Plaintiff's claim brought pursuant to the Equal Pay Act is not clearly dismissible pursuant to 1915(e) and therefore this action shall proceed as to that claim. This ruling is without prejudice to Defendant's filing of a proper Rule 12 motion. Because Plaintiff is proceeding in forma pauperis, Federal Rule of Civil Procedure 4(c)(3) requires the Court to order service for him. Accordingly, the clerk is designated pursuant to Rule 4(c)(3) to issue process to Defendant Family Dollar Store in the manner specified by Rule 4(d). Process shall consist of the complaint (Dkt. 1), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. Copies Mailed.
