ORDER Screening Complaint, Dismissing Insufficient Claims, and Directing Issuance of Process. Mr. Dotson's claim under the Eighth Amendment to the United States Constitution and Article I, Section 16 of the Indiana Constitution shall proceed against Dr. Mitcheff and Dr. Perez. His Eighth Amendment policy claim shall proceed against Wexford of Indiana, LLC. All claims against Indiana Department of Correction are dismissed for failure to state a claim upon which relief can be granted. These are the only claims the Court discerns in the complaint. If Mr. Dotson believes that additional claims were alleged in the complaint, but not identified by the Court, he shall have through February 19, 2021, in which to identify those claims. The clerk is directed to terminate Indiana Department of Correction as a defendant on the docket. The clerk is directed, pursuant to Federal Rule of Civil Procedure 4(c)(3), to issue process to defendants (1) Dr. Mitcheff, (2) Dr. Perez, and (3) Wexford of Indiana, LLC in the manner specified by Rule 4 (d). Process shall consist of the complaint, dkt. #1 , applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. The clerk is directed to serve Wexford of Indiana, LLC, electronically. Additionally, Dr. Mitcheff and Dr. Perez have been identified as employees of Wexford. In the event neither defendant waives service, Wexford is ORDERED to provide the full name and last known address of these defendants if it has such information. ORDER granting Plaintiff's #2 Motion for Leave to Proceed in forma pauperis to the extent that the plaintiff is assessed an initial partial filing fee of Twenty-Five Dollars and Sixty-Six Cents ($25.66).
