April 20, 2023 Opinion or Order Filing 167 ORDER - In our October 29, 2021 Order addressing the parties' cross-motions for summary judgment, we ruled on Plaintiffs' claims brought pursuant to the Administrative Procedures Act ("APA") challenging the HHS's General Counsel's December 30, 2020. Our rulings with regard to those claims have been cross appealed by the parties, which appeals are currently pending before the Seventh Circuit.To date we have refrained from ruling on the parties' cross-motions for summary judgment regarding Plaintiffs' ADR claims in light of the parties' pending cross-appeals at the Seventh Circuit. Given the length of time since our summary judgment order was issued, and the continued uncertainty of the timing of an appellate ruling, the parties are hereby ORDERED to meet and confer and submit to the Court a joint status report replying questions.
