ORDER Screening Complaint, Dismissing Deficient Claims, and Directing Issuance and Service of Process. The clerk is directed pursuant to Federal Rule of Civil Procedure 4(c)(3) to issue process to defendant Sgt. R. Schildmeire in the manner specified by Rule 4(d). Process shall consist of the complaint, dkt. #1 , applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. The clerk is authorized to serve the process electronically.The clerk is directed to terminate Wendy Knight, Robert Stafford, and Mr. Hall as defendants on the docket. An Eighth Amendment excessive force claim shall proceed against defendant Sgt. R. Schildmeire. All other claims and defendants have been dismissed. Mr. Slover shall have through April 9, 2021, in which to file a motion to reconsider bringing any overlooked claims and/or defendants to the Court's attention. (See Order). ORDER Denying Motion to Reconsider and Denying Motions for Discovery Orders. Plaintiff Justin Ryan Slover's March 5, 2021, motion to reconsider the Order denying his motion to reassign the Magistrate Judge, dkt. #12 , is denied. Mr. Slover's seven motions filed March 5, 2021, seek orders for the depositions of witnesses and the production of evidence. The motions, dkts. #13 , #14 , #15 , #16 , #17 , #18 , and #19 , are denied. The initial partial filing fee assessed in the Court's Order of February 19, 2021, has not yet been paid and the complaint has not yet been screened. After the complaint is screened and claims directed to proceed, defendants will appear and answer. If the case proceeds to the discovery phase, Mr. Slover may conduct discovery in accordance with any scheduling order issued by the Court. The Court further advises it does not provide or pay for court reporters or pay for transcripts; such expenses must be paid for by the litigants. Copy to Plaintiff via U.S. Mail. ORDER granting Plaintiff's #8 Motion for Leave to Proceed in forma pauperis to the extent that the plaintiff is assessed an initial partial filing fee of sixteen dollars and seventy-six cents ($16.76). See 28 U.S.C. 1915(b)(1) (A). The plaintiff shall have through March 23, 2021, in which to pay this sum to the clerk of the district court. The plaintiff is informed that after the initial partial filing fee is paid, he will be obligated to make monthly payments of 20 percent of the preceding month's income each month that the amount in his account exceeds $10.00, until the full filing fee of $350.00 is paid. 28 U.S.C. 1915(b)(2). After the initial partial filing fee is received, a collection order will be issued to the plaintiff and the plaintiff's custodian, and the Court will screen the complaint in accordance with 28 U.S.C. 1915A.
