Filing 5 ORDER granting #4 Motion for Leave to Proceed in forma pauperis. Thus, the Court will not dismiss the case insofar as the complaint is read to bring a claim to compel approval of the firearm transfer under 18 U.S.C. 925A. However, the Bivens claims are dismissed for the reasons stated above. This Order is without prejudice to a properly filed Rule 12 motion. Because Plaintiff is proceeding in forma pauperis, Rule 4(c)(3) requires the Court to order service for Plaintiff. Accordingly, the Clerk is designated pursuant to Rule 4(c)(3) to issue process to Defendants the United States and the FBI in the manner specified by Rule 4(i). The Marshal for this District or his Deputy shall serve the summons, together with a copy of the complaint, (ECF No. 1), and a copy of this Order, on the United States and the FBI pursuant to Rule 4(i), at the expense of the United States.
