Filing 5 ENTRY - DISMISSING ACTION AND DIRECTING ENTRY OF FINAL JUDGMENT. The Court gave the Plaintiffs an opportunity to amend their Complaint no later than February 19, 2021, and show cause why this case should not be dismissed because of a lack of subject- matter jurisdiction. The Plaintiffs have not responded to the show cause Order and have not filed an amended complaint to cure the jurisdictional deficiencies of their initial Complaint. Thus, Plaintiffs have failed to show cause why this case should not be dismissed for a lack of jurisdiction. Accordingly, for the reasons discussed in the prior Entry (Filing No. #4 ), this action is dismissed for lack of jurisdiction. See 28 U.S.C. 1915(e)(2)(B). Final judgment consistent with this Entry will be issued under separate order. Copy to Plaintiff via US Mail. Signed by Judge Tanya Walton Pratt on 2/26/2021.(NAD) |
Filing 4 ENTRY - GRANTING #2 MOTION TO PROCEED IN FORMA PAUPERIS, SCREENING AND ORDER TO SHOW CAUSE - For the reasons stated above, the Plaintiffs' Request to Proceed in District Court Without Prepaying the Filing Fee (Filing No. #2 ) is GRANTED. Having screened the Complaint, the Court finds it is subject to dismissal for lack of subject-matter jurisdiction. The Plaintiffs are granted leave to file an amended complaint by no later than Friday, February 19, 2021. If no amended complaint is filed by that date, this action will be dismissed for the reasons set forth above. (See Entry.) Copy to Plaintiffs' via US Mail. Signed by Judge Tanya Walton Pratt on 2/1/2021. (NAD) |
