Filing 7 ORDER - Plaintiff Kenneth Felder moves to extend time to respond to the Court's February 10, 2021 Entry, (ECF No. 4), to allow him to address a mediation recommendation by the U.S. Equal Employment Opportunity Commission. Plaintiff's motion, (ECF No. 6), is granted. Accordingly, Plaintiff now has until April 7, 2021, to respond to the Court's February 10, 2021 Entry. Signed by Judge James R. Sweeney II on 3/18/2021. Copy to Plaintiff via US Mail. (DWH) |
Filing 6 MOTION for Extension of Time to Respond to the Order on 2/10/2021 dkt. #4 , filed by Plaintiff KENNETH FELDER. (JDC) |
Filing 5 NOTICE of Lawsuit & Waiver Issued by Clerk sent to Raytheon Human Resources Department (RAGS) (JDC) |
Filing 4 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff's motion to proceed in forma pauperis, (ECF No. 2), is granted. Plaintiff's Title VII claims for race, sex, and gender discrimination, and Plaintiff's failure to accommodate and retaliation claims against Defendant Raytheon Human Resources Department are dismissed. All claims against Defendant Staffing Industry Analysts are dismissed. Plaintiff's failure to hire claims under the ADA and ADEA shall proceed. This ruling is without prejudice to the filing of a proper Rule 12 motion. Plaintiff has through March 8, 2021, in which to either file an Amended Com-plaint that cures the pleading deficiencies and sufficiently states a claim, or otherwise show cause why Judgment consistent with this Entry should not issue. Because Plaintiff is proceeding in forma pauperis, Federal Rule of Civil Procedure 4(c)(3) requires the Court to order service for her. Accordingly, the Clerk is designated under Rule 4(c)(3) to issue process to Defendant Raytheon Human Resources Department in the manner specified by Rule 4(d). Process shall consist of the Com-plaint (ECF No. 1), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. (Copy to Plaintiff via U.S. mail) Signed by Judge James R. Sweeney II on 2/10/2021. (Attachments: #1 Notice of Pro Se Litigant) (JDC) |
