March 1, 2021 Opinion or Order Filing 5 ORDER Directing Filing of a Complaint - Mr. Jeremy Jordan submitted a letter to the Court stating that he has serious medical needs that have gone untreated at the Wayne County Jail. He states the he wants "to file a lawsuit on whoever is responsible.... Please help me get my process started." Dkt. 1. Mr. Jordan is notified that there is only one means by which to commence a civil action in federal court. That means is through the filing of a complaint. Mr. Jordan's letter is not a complaint and the Court cannot assist Mr. Jordan by identifying who he should name as a defendant. According to Rule 3 of the Federal Rules of Civil Procedure, a civil action is commenced upon the filing of a complaint with the Court. If Mr. Jordan wishes to file a lawsuit, he must file a complaint. To assist Mr. Jordan, the clerk is directed to include a Prisoner Civil Rights Complaint Form along with Mr. Jordan's copy of this Order. If a complaint is submitted, Mr. Jordan must place the above cause number, No. 1:21-cv-00380-JPH-TAB, on the complaint and the court will direct its further processing as warranted. In addition, if Mr. Jordan takes that step (submitting a complaint) he contemporaneously must either pay the $400.00 filing fee or demonstrate that he lacks the financial ability to do so. Failure to file a complaint by March 24, 2021, will result in the dismissal of this civil action without prejudice. Signed by Judge James Patrick Hanlon on 3/1/2021. Copy to Plaintiff via US Mail.
