August 26, 2021 Opinion or Order Filing 12 ENTRY SCREENING AND DISMISSING COMPLAINT AND PROVIDING OPPORTUNITY TO AMEND - The dismissal of the complaint will not lead to the dismissal of the action at present. Instead, Mr. Brumback shall have through September 23, 2021, to file an amended complaint. The amended complaint must (a) contain a short and plain statement of the claim showing that the plaintiff is entitled to relief, which is sufficient to provide the defendant with fair notice of the claim and its basis; (b) include a demand for the relief sought; and (c) identify what injury he claims to have suffered and what persons are responsible for each such injury. In organizing his complaint, the plaintiff may benefit from utilizing the Court's complaint form. Any amended complaint should have the proper case number, 1:21-cv-02027-JRS-MJD, and the words "Amended Complaint" on the first page. The amended complaint will completely replace the original. Therefore, it must set out every defendant, claim, and factual allegation the plaintiff wishes to pursue in this action. If the plaintiff files an amended complaint, it will be screened pursuant to 28 U.S.C. 1915A(b). July 31, 2021 Opinion or Order Filing 8 ORDER GRANTING RENEWED MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS - Mr. Brumback's renewed motion for leave to proceed in forma pauperis, dkt. #7 , is granted. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b) (1) ("the prisoner shall be required to pay the full amount of a filing fee."). The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. 28 U.S.C. 1915(b)(4).
