Order Discussing Service - On August 5, 2021, Plaintiff Tamica J. Smithson filed a complaint against Defendant Lloyd J. Austin III, the Secretary of the Department of Defense, alleging employment discrimination under Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act of 1990. She paid the filing fee and attached a proposed summons to her complaint.The Clerk shall endorse and return the summons tendered by Plaintiff to Plaintiff. Plaintiff is responsible for service of process on Defendant as required by Federal Rule of Civil Procedure 4 unless a further specific request is made that court officers effect service of process. See Fed. R. Civ. P. 4(c)(3). Before doing so, Plaintiff is requested to review Rule 4, specifically including subsection (c)(2), which explains who may serve a summons and complaint, and subsection (i), which sets forth requirements for serving United States employees.
