October 12, 2021 Opinion or Order Filing 6 ORDER - Pro se Plaintiff James Martin, a familiar litigant in this Court,filed this action on August 18, 2021, alleging that Tri-State Valet, Inc. has failed to "design, construct, and/or operate a website that is fully accessible to, and independently usable by, blind people" in violation of the Americans with Disabilities Act and the Indiana Civil Rights Law. [Dkt. 1 at 2.] Plaintiff has also filed a motion for leave to proceed in forma pauperis in this case. [Dkt. 2.] On August 19, 2021, Plaintiff filed motion to dismiss without prejudice because "all matters have been resolved.[dkt 5]. The Court now GRANTS Plaintiff's motion to dismiss Dkt. #5 . This dismissal is with prejudice because all matters have been resolved. Plaintiff's motion to proceed in forma pauperis Dkt. #2 is DENIED as moot. Signed by Judge Sarah Evans Barker on 10/12/2021.
