Filing 5 RESPONSE, re #4 Order, Submission of Trust Account Information, filed by Plaintiff WILLIAM JAMES STEVENS. (Attachments: #1 Envelope). (MAC) |
Filing 4 ORDER - On August 27, 2021, pro se Plaintiff William James Stevens filed a Complaint, [Filing No. 1], and a Motion to Proceed In Forma Pauperis, [Filing No. 2]. In support of his Motion to Proceed In Forma Pauperis, Mr. Stevens detailed his current lack of income and assets, under penalty of perjury. [Filing No. 2.] However, because Mr. Stevens is a prisoner currently in custody, he must also file "a certified copy of the trust fund account statement (or institutional equivalent) for the prisoner for the 6-month period immediately preceding the filing of the complaint..., obtained from the appropriate official of each prison at which the prisoner is or was confined," 28 U.S.C. 1915(a)(2), which he failed to do. Accordingly, the Court ORDERS Mr. Stevens to file by September 30, 2021 a certified copy of his trust fund account statement for the 6-month period immediately preceding August 27, 2021 (the date he filed his Complaint). Failure to do so may result in dismissal of this case. Copy to Plaintiff via U.S. Mail. Signed by Judge Jane Magnus-Stinson on 8/31/2021. (MAC) |
