Filing 8 ORDER Denying Motion to Amend the Complaint as Moot - Anthony Williams, pro se, is confined to Bartholomew County Jail. His complaint has not yet been screened by the Court, and the defendants have not been served. On September 24, 2021, he filed a motion for leave to amend the complaint. At this time, Mr. Williams does not need the Court's permission to file an amended complaint. A plaintiff may amend the complaint "once as a matter of course within... 21 days after service of a responsive pleading or 21 days after service of a motion under Rule 12(b), (e), or (f), whichever is earlier." See Fed. R. Civ. P. 15(a)(1)(B). Accordingly, the motion to amend, dkt. [ #7 ], is denied as moot. The clerk is directed to send Mr. Williams a prisoner complaint form with his copy of this Order. Mr. Williams should use this form if he chooses to file an amended complaint. If possible, the Court requests that Mr. Williams use printed, rather than cursive script, for his future filings to ease the Court's review. See Order for additional information. Copies to Plaintiff via US Mail. Signed by Magistrate Judge Doris L. Pryor on 10/1/2021. (SWM) |
