ORDER - Plaintiff James Napier initiated this employment discrimination lawsuit on August 31, 2021, and it was originally assigned to our colleague, the Honorable James Patrick Hanlon. It was thereafter reassigned to the undersigned judge on September 16, 2021 on grounds that it is related to Napier v. Orchard School Corporation, No. 1:19-cv-3556-SEB-DLP, a case already pending on this judge's docket. Mr. Napier should have moved to amend the complaint in his earlier-filed case to add additional claims rather than initiate a new lawsuit. Having failed to do so, we find under the current circumstances that the consolidation of these cases is appropriate pursuant to Federal Rule of Civil Procedure 42(a). Accordingly, the Clerk is directed to procedurally close this action, Napier v. Orchard School Corporation, No. 1:21- cv-02363-SEB-DLP, and consolidate it into Napier v. Orchard School Corporation, No. 1:19-cv-03556-SEB-DLP. Additionally, the Clerk is directed to docket this order in both cause numbers.
