Filing 19 ORDER on Pending Matters - The amended complaint filed in this case asserts claims by Mr. Mackie, both on his own behalf and on behalf of his minor daughter. On November 4, 2021, the court issued an order noting that claims brought on behalf of the minor by and through her parent in a representative capacity require the representative to have counsel (Dkt. #16 ). That order also gave the parent representative until December 6, 2021, to obtain counsel for those claims. On November 9, 2021, Mr. Mackie filed a response to that order that, among other things, requests the dismissal of the claims of his daughter while reserving the right to re-file her claims with counsel later. (Dkt. #17 ) Dismissal is unnecessary in this instance because clarity in the pleadings will be served by Mr. Mackie filing a second amended complaint asserting his individual claims only, and the court hereby grants him leave to do so. He shall make this filing by December 3, 2021, and the defendants shall respond to it within the time permitted by Fed.R.Civ.P. 15(a)(3). On November 15, 2021, the defendants filed a motion for a 14-day extension, to December 13, 2021, to respond to the amended complaint. (Dkt. 18) The defendants recite in support of that motion that they are "uncertain what to make of the state of the docket." The filing of a second amended complaint will make the extension sought unnecessary, so the motion at Dkt. #18 is DENIED AS MOOT. See Order for additional information. Copy to Plaintiffs via US Mail.
