Filing 9 ORDER ON MOTION FOR EXTENSION OF TIME - On December 7, 2021, a motion for extension of time to respond to the Court's show cause order was filed. See dkt. 8. The motion does not appear to have been filed by Mr. Cason; rather, it is signed by another individual, Valerie Hill, on behalf of Mr. Cason. Id. The motion indicates that Mr. Cason requests an additional 30 days to file his response to the show cause order because he is currently in a lockdown unit at the facility "which makes him unable to provide and/or receive documents in a timely" manner, "even with the e-filing[.]" Id. The motion for extension of time, dkt. [ #8 ], is DENIED because Ms. Hill is not a party or an attorney. See Georgakis v. Ill. State Univ., 722 F.3d 1075, 1077 (7th Cir. 2013) ("A nonlawyer can't handle a case on behalf of anyone except himself."). However, the Court sua sponte extends Mr. Cason's deadline to respond to the show cause order. Mr. Cason shall have through January 14, 2022, to (1) notify the Court of where the incident, that is the subject of his complaint, occurred and (2) to show cause why this action should not be transferredto the Northern District of Indiana. Signed by Magistrate Judge Debra McVicker Lynch on 12/14/2021. (SWM) |
Filing 8 MOTION for Extension of Time to in which to #7 Order to Show Cause, filed by Plaintiff KIONTAY CASON. (AKH) |
Filing 7 ORDER TO SHOW CAUSE - Plaintiff Kiontay Cason is an Indiana Department of Correction (IDOC) inmate currently incarcerated at Westville Correctional Facility, a prison located in LaPorte County, which falls within the Northern District of Indiana. Mr. Cason filed this civil rights action pursuant to 42 U.S.C. 1983 on October 29, 2021. Dkt. #2 . Mr. Cason's complaint names the Warden and several correctional officers at Westville, as well as the IDOC Commissioner. Id. Mr. Cason's allegations appear to arise out of an incident on May 26, 2020 in which he claims he was assaulted. Id. From the face of the complaint, it appears that this incident may have taken place at Westville. If so, this means that the alleged constitutional violations occurred in the Northern District of Indiana. Mr. Cason shall have through December 15, 2021, in which to (1) notify the Court of where the incident, that is the subject of his complaint, occurred and (2) to show cause why this action should not be transferred to the Northern District of Indiana. (See Order). Signed by Judge Tanya Walton Pratt on 11/16/2021. (AKH) |
