ORDER on In Forma Pauperis Status - The plaintiff filed a motion to waive the initial partial filing fee, which the Court construes as a motion to reconsider the Court's previous Order on Motion to Proceed In Forma Pauperis. The motion to reconsider, dkt. #9 , is granted. The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. 28 U.S.C. 1915(b)(4). ORDER Denying Motion to Produce Evidence - Plaintiff Michael Faucett has filed a motion asking the Court to issue a subpoena requiring the administration at his prison to produce certain evidence that he believes will support his claims in this suit. His motion, dkt. [ #3 ], is denied without prejudice. If Mr. Faucett pays the initial partial filing fee as required by the Court's Order of December 1, 2021, dkt. #6 , and his complaint survives screening, he will have an opportunity to conduct discovery that will allow him to request evidence and other information that might support his claims.
