ORDER - ASSESSING INITIAL PARTIAL FILING FEE; On December 7, 2021, the Court docketed the plaintiff's trust account statement which had been submitted on December 3, 2021. Dkt. 9. Therefore, the Court's order to the Warden to produce the trust account is vacated. The plaintiff is assessed an initial partial filing fee of Three Dollars and Sixty-Five Cents ($3.65). See 28 U.S.C. 1915(b)(1). The plaintiff shall have through January 10, 2022, in which to pay this sum to the clerk of the district court. Signed by Judge Sarah Evans Barker on 12/9/2021. ***VACATED PER ORDER #10 *** ORDER DIRECTING PLAINTIFF'S CUSTODIAN TO FORWARD CERTIFIED COPY OF PLAINTIFF'S SIX-MONTH TRUST ACCOUNT STATEMENT - This matter comes before the Court on Plaintiff's Motion for Court Assistance with Providing Trust Account. For the reasons explained below, the motion, dkt. #4 . is GRANTED. Accordingly, the Court hereby ORDERS the Warden of Pendleton Correctional Facility or his designee to provide the Court with a certified copy of Plaintiff's trust account statement for the six-month period preceding the filing of this action on November 29, 2021, and to do so no later than December 27, 2021. The trust account statement should be submitted to the Clerk of the Court and should reference case number No. 1:21-cv-02938-SEB-DML. Upon receipt of the required financial statement, the Court will reassess what initial partial filing fee must be paid, if any, and whether a collection order should enter to collect the filing fee (SEE ORDER).
